TERMS AND CONDITIONS

As a condition of using this website, you agree to comply with and be subject to the following terms and conditions of use. This agreement is between you and Endeavour Group Limited trading as Oakridge Wines (ABN 77 159 767 843) (“Oakridge Wines”).

AGREEMENT

Ordering through Oakridge Wines’ website

When placing an order on our website for the first time, we will ask you for verification that you are over the age of 18. If you are placing an order to be delivered to another person, we will also ask you to confirm that the order recipient is over the age of 18.

Delivery

Delivery address

You agree that the address to which we may deliver is the address you gave for delivery as part of your order.

Delivery to yourself

If you are the recipient of your order, we are required by law to instruct the person delivering your order that the liquor must only be delivered and received by you, and your age must be verified by the delivery person via an acceptable form of identification.

Delivery to another person

If you are placing an order as a gift for another person, and provided you have verified the gift recipient is over 18 years, we are required by law to instruct the person delivering the order that the liquor must only be delivered to the recipient or to another person who is of or over 18 years and present at the address provided. The delivery person must verify the age of the recipient via an acceptable form of identification. You agree that we may rely on any person who is at the address you gave for delivery, and who takes receipt of your ordered products, as being authorised for that purpose.

Delivery pre-conditions

Oakridge Wines takes its obligations to ensure and facilitate the Responsible Service of Alcohol seriously and we will not deliver your order if we consider any delivery circumstances are unsuitable for any reason, including because (1) we believe the order recipient is intoxicated; (2) we have a reasonable belief that an adult is purchasing alcohol on behalf of a minor or will supply alcohol to a minor; (3) the order recipient is in a school uniform, including a sports uniform, even if the individual is over the age of 18; and (4) the order recipient is under the age of 18.

We may not deliver your order if any of our requests for verification (such as proof of identity or age) are not met.

Delivery records

We may record all details relating to deliveries, including details of age verification and taking a photograph of the completed delivery.

We are obligated to record details of each occasion where a delivery person refuses to deliver an order for any of the following reasons: 

  • the recipient was a minor; 
  • in the case of a first-time order that is not a gift, the person who placed the order was not home to accept the order or could not provide appropriate identity verification;
  • in the case of a gift, neither the recipient or another person at the delivery address was present or able to produce an evidence of age document;
  • the recipient was intoxicated or there was a substantial risk they were intoxicated.

We will only use and disclose such records for reasonable purposes, which may include proof of delivery, administration, and complying with record keeping requirements under liquor licensing laws and law enforcement.

Delivery delays

You accept the risk that occasionally, due to unforeseen circumstances, deliveries may be delayed. We will not be liable or responsible for any failure or delay in delivery that is caused by any act or event beyond our reasonable control. 

Returns and refunds

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

If a product you have purchased from Oakridge is faulty, damaged (excluding damage caused by misuse), wrongly described, or breaches a consumer guarantee, we will happily refund your money, exchange or, where possible, repair the product.  If your purchase incurred a delivery fee, we will also cover the cost of delivery for the return. Please contact us for assistance. 

Non-delivery postcodes

In line with our commitment to the Responsible Service of Alcohol (RSA) and as a signatory of Retail Drinks Australia’s Online Code of Conduct, there are several postcodes in Australia to which we do not deliver under any circumstances.

Cancellation of orders

Cancellations by us

Your order is an offer to buy from Oakridge Wines and we may cancel your order before completion of delivery in whole or in part. If we are unable to accept your order because the ordered products are not available, we will contact you to suggest an alternative of equal or greater value or refund you the full amount. If we are unable to deliver your order for any reason, we will inform you and refund you the full amount. If we are unable to deliver because these terms and conditions have not been complied with, the delivery fee will be deducted from your refund.

Cancellations by you

You agree that you cannot make changes to an order after it has been placed. If you change your mind and would like to cancel or amend your order, please contact us to discuss your options. 

Risk

You agree that risk of loss or damage to products relating to your order passes on delivery of them including where delivery is to unattended locations (such as locations which are not attended by any person or which are attended by a person who is not acting on your behalf).

Title and place of supply

You agree that title to the products you purchase (and the place of our supply of those products to you) occurs at the place where we dispatch the products to your order. We do not supply alcohol to you from places which are not licensed under applicable alcohol licensing laws, even though such other places may be the delivery location. 

Wine Club

Membership

By joining a Wine Club, you agree to a membership subscription to receive the goods and services described on our website in respect of the elected membership tier (“subscription”). 

It is your responsibility to ensure that the selected Wine Club is suitable for you and you acknowledge that each tier of our Wine Club provides different products and services at different price points and different timings.

Billing

Subscriptions are an ongoing service and will be automatically renewed in line with the billing cycle of your chosen subscription unless you elect to cancel. We will use our best endeavours to notify you by email at least 7 days prior to your next billing date.

The cost of your membership will be charged to the active card listed on your Wine Club account. You can update your payment details at any time on our website by logging into your Wine Club account, which will update them for your next billing cycle. We take the protection of your data seriously, to find out more please refer to our Privacy Policy.

If your payment fails on the billing date for any reason (including credit card failure or incorrect card details), we will not dispatch your delivery (if applicable) and we will contact you to notify you of the payment failure. If we continue to experience issues processing your payment and are unable to get in touch with you, we will cancel your Wine Club membership.

Product availability

All products (including vintages of products) in our curated Wine Club packs are subject to availability. If a product becomes unavailable, an alternative product of equal or greater value will be substituted at no additional cost. 

Cancelling or suspending membership

You may cancel or suspend your Wine Club membership at any time by calling us on (03) 9738 9900 or emailing us at wineclub@oakridgewines.com.au.  

If you would like to cancel your membership, you must notify us at least 72 hours prior to your next billing date, otherwise you will be charged for your next delivery.

Information published on this website may refer to products or services that are not available in your country. Our website is directed to users who are at least 18 years old located in Australia.

Disclaimer

Without excluding, restricting or modifying the rights and remedies to which you may be entitled under these consumer guarantees provisions of the Australian Consumer Law or our liabilities under those provisions:

  • We exclude all implied terms and warranties, whether statutory or otherwise, relating to our website, the subject matter of our agreement with you and all content to or from which the website is linked. 
  • We will not be liable to you for indirect and consequential loss arising from or connected to our agreement with you in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct;
  • Where we refund you the amount of your order as provided in your agreement with us, you agree such refund is the total amount of our liability to you for all circumstances relating to the refund.
  • Our liability to you for loss or damage of any kind arising out of our agreement with you or in connection with the relationship established by it, is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.
  • Nothing in this clause affects any liability which cannot be excluded or limited under applicable law. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. Where our liability cannot be excluded, we limit our liability to the fullest extent permitted by the Australian Consumer Law.
